The U.S. Election Assistance
Commission (EAC) is requesting an emergency reinstatement of the
National Mail Voter Registration form. Section 9(a) of the NVRA and
Section 802 of HAVA requires the responsible agency to maintain a
national mail voter registration form for U.S. citizens that want
to register to vote, to update registration information due to a
change of name, make a change of address or to register with a
political party by returning the form to their state election
office.
The EAC is requesting
emergency reinstatement with changes of the expired National Mail
Voter Registration form in order to gain compliance with OMB policy
in preparation for the upcoming election cycle in November 2021.
Federal law allows voter registration deadlines to be up to thirty
days prior to an election. 52 U.S.C. § 20507. That means for many
jurisdictions the National Mail Voter Registration form has to be
received by early October 2021. Therefore, given this impending
deadline, the public would be harmed if the normal procedures were
followed.

Reduction in burden was
achieved because more accurate and recent data from the 2020
Election Administration and Voting Survey (EAVS) show fewer
potential voters use this application form to register to
vote.
