The U.S. Election Assistance
Commission is proposing new regulations, created pursuant to 42
U.S.C. 1973gg-7(a). On July 29, 2009, a notice was published in the
Federal Register, stating that the Federal Election Commission
(FEC) and the Election Assistance Commission (EAC) jointly took
action to transfer regulations implementing the National Voter
Registration Act of 1993 (NVRA) from the FEC to the EAC. The Help
America Vote Act of 2002 (HAVA), transferred the FECs former
statutory authority regarding the NVRA regulations to the EAC. The
NVRA regulations mandate the state to provide EAC certain
information concerning state registration practices and prescribes
a Federal form which the public may use to vote.
Pursuant to 44 USC
3507(j)(1), the U.S. Election Assistance Commission is requesting
emergency approval. The data collection is needed prior to the
expiration of time periods established under 5 CFR 1320.13, and
essential to the mission of the U.S. Election Assistance
Commission. The normal clearance procedures are reasonably likely
to prevent the collection of information. Pursuant to 5 CFR
1320.13, the EAC will take all practicable steps to consult with
both the public and interested agencies in order to minimize the
burden of the collection of information.

The Federal Election Commission
("FEC") and the U.S. Election Assistance Commission ("EAC") jointly

is statutorily exempted from the provisions of the Paperwork
Reduction Act ("PRA"), while the EAC is not. Therefore, this
existing information collection does not have an associated OMB
control number. The EAC's proposed NVRA regulation transfer does
not create a new burden for states in the processing of voter
registration forms as states would be required to process these
forms irrespective of the existence of the proposed EAC
regulations.
