The proposed regulations in Part 43
impose certain recordkeeping and public reporting requirements on
the following entities; swapts execution facilities ("SEFs")
designed contract markets ("DCMs"); swap data repositories
("SDRs"); major swap participants ("MSPs"); swap dealers ("SDs")
and to the extent that one is created, an entity that will
consolidate and publish real-time swap transaction and pricing data
(a "third party service provider"), to being transparency to the
swaps markets. With respect to the Block Trades, the proposed
regulations seek to amend the collection of information provided
for in §§ 43.4 and 43.6 to part 43 that impose certain
recordkeeping and public reporting requirements on the following
entities; swap execution facilities ("SEFs") designed contract
markets ("DCMs"); swap data repositories ("SDRs"); major swap
participants ("MSPs"); swap dealers ("SDs") and non-SDs/MSPs to
consolidate and publish real-time swap transaction and pricing data
to bring transparency to the swaps markets. Proposed § 43.6(g)
would provide for the election to have swap transactions treated as
block trade or large notional off-facility swap. Proposed §§
43.4(d) and 43.4(h) would require public dissemination of publicly
reportable swaps in other commodity asset class with a mask based
on geographical detail and provide for SDRs to publicly disseminate
swap transaction and pricing data with cap sizes issued by the
Commission.
