WHO MUST REPORT AND SANCTIONS
Response to the EIA-888 Schedule B survey is mandatory pursuant to Section 13(b) of the Federal Energy Administration Act of
1974 (Public Law 93-275) for the scientifically selected sample of companies which sell motor vehicle diesel fuel. Companies
sampled are notif ied in writing or by telephone in advance.
The timely response of Form EIA-888 Schedule B by those required to report is mandatory under 15 USC 772, as amended.
Failure to respond may result in a civil penalty of not more than $12,937 per day for each violation. The government
may bring a civil action to prohibit reporting violations which may result in a temporary restraining order or a preliminary or permanent injunction without bond. In such civil action, the court may also issue mandatory injunctions commanding any person to
comply with these reporting requirements.

PURPOSE
The U.S. Energy Information Administration (EIA) Form EIA-888, On-Highway Diesel Fuel Price Survey, is a mandatory survey
consisting of two parts: Schedules A and B.
• Schedule A is designed to collect data on the cash price (including taxes) of self-serve, on-highway diesel fuel. Schedule A
is conducted on a weekly basis.
• Schedule B is designed to collect total annual sales volume for on-highway diesel fuel sold at your station during a full calendar year. Schedule B is conducted only once when your station was selected in a new sample for the survey, and the
data are collected strictly for internal statistical purposes and will not be published.
The data are used to calculate average diesel fuel oil price estimates at the national, regional, and select State levels which are
vital to the trucking industry and shippers throughout the United States. These data are point-in-time estimates as of 8:00 a.m.
Monday.
