Abstract: No material/nonsubstantive change - BJS is proposing adding a column to the Private/Contract facility roster form to collect whether the youth was placed by the state as a “yes” or “no” variable. On September 4, 2003, the Prison Rape Elimination Act of 2003 (PREA or the Act) was signed by the President (Public Law 108-79; see Attachment 1). The Act requires the Bureau of Justice Statistics (BJS) to "carry out, for each calendar year, a comprehensive statistical review and analysis of the incidence and effects of prison rape." The Act further instructs BJS to collect survey data: "…the Bureau shall…use surveys and other statistical studies of current and former inmates…" The law was passed in part to overcome a shortage of available research on the incidence and prevalence of sexual violence within correctional facilities. The National Survey of Youth in Custody is the only national source of information on the number of sexual assault victims within juvenile correctional facilities. This part of the collection fulfills the legislative requirement to obtain data directly from youth in order to generate a facility level estimate of sexual assault.

Short Statement: The overall number of burden hours requested has declined from 13,161 (NSYC-2) to 12,533 (NSYC-3). Relative to NSYC-2, two changes affect burden: The first is a reduction of estimated youth interviews. Table 1 reflects a reduction in the number of estimated youth interviewed from 9,950 in NSYC-2 to 8,690 in NSYC-3. While the average length of the youth interview has increased from 30 to 35 minutes, this increase is offset by the smaller number of youth interviews expected for NSYC-3. The second factor is that the estimated number of participating facilities has decreased from 363 to 354, reflecting national trends in fewer juvenile facilities.
