In accordance
with 5 CFR 1320, OMB advises DOT to correct its inaccurate
statement in the PRA section of the NPRM that the Bureau of
Explosives (BOE) no longer exists. In addition, the agency should
complete the following actions prior to resubmitting this
information collection: 1) quantify additions or subtractions of
burden hours associated with 49 CFR 172.205, 49 CFR 172.504, 49 CFR
173.301(a)(9), and 49 CFR 180.212; 2)explain and justify why dual
submission of certain required reports to the AAR is necessary and
appropriate; and 3) summarize any comments received pertaining to
the information collection and reporting burdens and indicate any
changes made as a result of these comments.

(HM-218C NPRM) This information
collection assures safe transpor- tation of hazardous materials by
rail by verifying that rail tank car tanks are manufactured,
maintained, and operated in a safe manner that they will safely
contain hazardous materials during transportation, and promote
compliance with the HMR.
