In accordance
with 5 CFR 1320, the information collection was improperly
submitted. The response to comments on the existing information
collection indicates that the agency did not assess the practical
utility of the information collection and, thereby, did not comply
with 5 CFR 1320.8. The agency should address the comments regarding
the practicaly utility of the Plans of Operations submitted for the
Siskiyou National Forest. The agency is also directed to review
their directions to ensure that respondents will not submit
information when they are exempt from these requirements.

These regulations notify the mining
community of the information requirements for a Plan of Operations,
Cessation of Operations, and a Notice of Intent. They also discuss
the distribution of information to others; inspections;
noncompliance; fire; access; appeals; and operations in wilderness
areas. These collections provide information to the authorize
officer so that the proposed impacts from mining proposals can be
minimized through environmental analysis. We expect serious,
long-lasting, and avoidable adverse impacts to be a common
occurrence without this these data collections and through the
