This ICR is approved for three years. This approval covers the information collection activities associated with the existing chemical testing program under section 4 of the Toxic Substances Control Act (TSCA). This ICR does not, however, include any burden or costs associated with new rulemakings that impose testing under section 4 of TSCA. In proposing a new test rule, EPA will continue to provide the estimated burden and costs associated with the proposed testing as part of the Regulatory Impact Analysis (RIA) prepared for the proposed rule, and will provide an opportunity for the public to comment on those estimates as part of the proposed rulemaking process. EPA will address any comments related to the paperwork burden that were received, and prepare a final burden and cost estimate in the RIA for the final rule. Before EPA can issue a final rule, EPA must submit this information to OMB along with an Information Correction Worksheet (ICW) requesting that this approval be amended to incorporate the new burden related to the final rule. In reviewing the ICW, OMB may request additional information to help in its determination. OMB may require that EPA develop a complete supporting statement for the ICR if it appears that the test rule contains information collection activities different from those described in this ICR, or are otherwise highly unusual, controversial, or inconsistent with this clearance. When deciding to require a separate review, OMB will consider the following: (1) total amount of burden/cost and burden/cost per respondent; (2) the number of respondents affected; (3) the degree of similarity (i.e. frequency of use, level of burden and content) with the collections administered under this ICR; (4) the evidence of duplication with other collections; (5) the degree and extent of public concern expected; and (5) the environmental and health consequences if the collection is given a separate review.
