EPA shall report
annually to OMB its experience with this program for the purpose of
monitoring the accuracy of burden estimates. Specifically, annual
reports should include number of test rules, consent orders, and
multi-chemical test rules, and number of participating companies
and chemicals tested for each rule, for the preceding year. They
should also include approximate annual burden estimates for each
test rule and consent order. OMB understands that EPA has been
working to update the studies on which the cost and burden
estimates for this rule are based and looks forward to seeing the
results of this update reflected in the next resubmission of this
ICR. OMB encourages EPA to continue working with representatives of
regulated industries to find ways of minimizing burden while still
obtaining necessary test results, and to ensure that burden
estimates are reasonable and up to date.

Rules and consent orders under TSCA
section 4 require that one manufacturer or processor of the subject
chemical perform specified testing so that the effort of
manufacturing, processing, distribution, use, and disposal of the
chemical on human health and the environment can be reasonably
predicted or determined. TSCA section 4 allows manufacturers of a
chemical subject to a test rule to either perform the required
testing or to apply for an exemption if that testing is being
performed by another.
