This approval
covers the burden hours associated with TSCA section 8(a)
rulemakings. As part of this approval, EPA shall provide OMB with
several items for each TSCA 8(a) rulemaking issued during the
three-year period covered by this approval. EPA shall provide a
brief description of each rule prior to publishing hte proposed
rule in the Federal Register. Before issuing a final rule, EPA
shall provide OMB with a copy of the draft final rule, a summary of
any comments received, and an explanation of how EPA addressed the
comments. OMB will review the information collection activities
associated with each individual rule to ensure compliance with 5
CFR 1320.5 (d)-- e.g. the collection of information is the least
burdensome necessary for the proper performance of the agency's
functions; the collection of information is not duplicative of
information otherwise accessible to the agency. OMB may disapprove
any individual submission under this clearance if it fails to meet
th e criteria outlined in 5 CFR 1320.5 (d). OMB will promptly
contact the Agency with any questions or requests for further
information regarding a particular submission. If, 15 business days
after confirming OMB receipt of the submission, WPA has not
received any such requests from OMB, the Agency may proceed with
the issuance of the final rule. EPA must provide the rule specific
burden estimates in the preamble for each proposed or final TSCA
section 8(a) rule. EPA should also track the burden estimates for
each rule issued under this ICR and submit a technical amendment to
this ICR if the burden for any rule or the total annual burden in
any given year exceeds the 275 hours approved under this ICR.
Finally, EPA should summarize in its next ICR, the actual annual
burden hours incurred under this ICR.

Section 8(a) rules persons to notify
EPA if they manufacturer, import or process or propose to
manufacture, import or process the chemical substance or mixture
identified in the 8(a) rule. The notice enables EPA to monitor the
production, importation, and use of the identified chemical
substance or mixture.
