OMB reserves the
right to review any individual request based on comments received
by EPA or OMB during the 8(a) comment period. EPA will inform OMB
of each new 8(a) rule publication in the Federal Register (both
proposed and final) and inform OMB of major comments that pertain
to the information sought. Additionally, EPA shall publish burden
estimates in the preamble for each rule. If EPA promulgates more
than three 8(a) rules over the next three years, it shall submit a
technical amendment to reflect the change in estimated burden to
industry and government. EPA shall summarize in its next ICR the
actual incurred 8(a) annual burden hours. OMB encourages EPA to
consider 8(a) reporting requirements in its business re-engineering
for EDI with industry and to report the results of this in the next
ICR. The previous approval was incorrectly noted as being for 1,940
hours, when it should have been for 276 hours.

TSCA section 8(a) rules require
persons to report certain chemical-specific information to EPA if
they manufacture, import, or process or propose to manufacture,
import, or process the chemical substance or mixture identified in
the 8(a) rule. This information enables EPA to monitor the
production, importation, and use of the identified chemical
substance or mixture.
