The information
collection requirements contained in the NPRM on due diligence in
the FFEL program are not approved at this time. OMB has concerns
about the burden and utility of the timing and content for notice
letters and preclaims requests that must be submitted by guarantee
agencies. The preamble to ED's final rule shall address these and
other public comments so as to minimize burden while maximizing the
usefulness of the collection requirements in the rule.

The due diligence provisions assures
the Secretary that the guaranty agencies and lenders pursue
aggressive and vigorous collection activities in collecting
delinquent and defaulted FFEL loans.
On behalf of this Federal agency, I certify that
