Non-substantive Change Justification Statement
Summary
SAMHSA requests a change to the approved data collection - National Survey on Drug Use and Health (NSDUH) (OMB No. 0930-0110, Exp. Date: 10/31/2027). In response to Executive Order 141681, SAMHSA is seeking OMB approval to remove all questions and confirmation follow-up questions that reference sex assigned at birth and gender identity.
Proposed Changes to the In-person and Web Screening Questions
This submission proposes the following minor changes to the approved 2025 in-person and web screening questions:
Revised SR SEX from “What sex were you assigned at birth, on your original birth certificate?” to “Are you male or female?”
Removed SR GENDER and SR DIFTERM.
Revised logic to use SR SEX instead of SR GENDER in SR MILITARY and SR HISPANIC.
Revised SEX from “What sex was this person assigned at birth, on their original birth certificate?” to “Is this person male or female?”. Also, removed the don’t know (“DN”) response option.
Removed GENDER and DIFTERM.
Removed “he” and “she” pronoun from HISPANIC and RACE to simplify the question. These questions now use only “Is this person…”.
Revised CONFIRM ROSTER to use “This person” instead of “they” and “is/is not” instead of “are/are not”.
Removed gender from VERIFY ROSTER DATA and EDIT ROSTER MEMBER.
Revised RESPONDENT SELECTION to include sex (M/F) instead of gender.
Proposed Changes to the In-Person and Web CAI Questionnaires
This submission proposes the following minor changes to the approved 2025 in-person and web CAI questionnaires (specifications included in Attachments N and WEB-4, respectively):
Revised QD01 from “What sex were you assigned at birth, on your original birth certificate?” to “Are you male or female?”.
Removed GI01 and GIOTH.
Removed SABFILL and GIFILL.
Removed CONFGI and all subsequent consistency check questions.
Redefined RSEX as RSEX = QD01.
Revised CHMONSEX from “What sex was the [CHAGEMON FILL]-month old child assigned at birth, on their original birth certificate?” to “Is the [CHAGEMON FILL]-month old child male or a female?”.
Revised CHYRSEX from “What sex was this child assigned at birth, on their original birth certificate?” to “Is this child male or female?”.
Revised PERYRSEX from “What sex was the [PERAGEYR FILL]-year old person assigned at birth, on their original birth certificate?” to “Is this [PERAGEFY FILL]-person male or female?”.
Revised PERSEX from “What sex was this person assigned at birth, on their original birth certificate?” to “Is this person male or female?”.
Updated questions in the Health Insurance and Income modules when a proxy is responding to include the correct pronoun (e.g., INTROFI1, INTROINC, and QI23b).
Removed “sexual orientation” and “gender identity”
Changed “ENGLISH: IF SEX =BLANK, “Answer required” is displayed offering “Don’t Know” and “Rather Not Say” as additional options” to “ENGLISH:IF SEX =BLANK, ‘Answer required’”
Removed the following SOGI related questions “QD62,” “QD63” and “QD63OTH”
Removed “Refused,” “R,” “U,” and “BLANK” response options from sex questions
Proposed Changes to the Parental Introductory Script
This submission includes a proposed change to the 2025 Parental Introductory Script (Attachment L). The proposed change is to revise the “one youth is selected” scenario to include “him/her/your child” and “he/she/your child” pronoun text fills instead of using the singular “they/them”.
