There are two primary provisions of
the proposed rule that may increase burden under the PRA. The first
is downstream notification, which would be carried out by updates
to the relevant SDS and which would be required for manufacturers,
processors, and distributors in commerce of PCE, who would provide
notice to companies downstream upon shipment of PCE about the
prohibitions. The information submitted to downstream companies
through the SDS would provide knowledge and awareness of the
restrictions to these companies. The second primary provision of
the proposed rule that may increase burden under the PRA is
WCPP-related information generation, recordkeeping, and
notification requirements (including development of exposure
control plans; exposure level monitoring and related recordkeeping;
development of documentation for a PPE program and related
recordkeeping; development of documentation for a respiratory
protection program and related recordkeeping; development and
notification to potentially exposed persons (employees and others
in the workplace) about how they can access the exposure control
plans, exposure monitoring records, PPE program implementation
documentation, and respirator program documentation; and
development of documentation demonstrating eligibility for an
exemption from the proposed prohibitions, and related
recordkeeping).
