Section 407 of PL 95-87 requires that non-consensual entry can be obtained where land or water resources have been adversely affected by past coal mining practices, and that the adverse effects are at a stage where public interest, action to restore, reclaim, abate, control or prevent should be taken. The Act requires that notice be given to property owners.
