Under the provision of section 410 of
the Jeff Miller and Richard Blumenthal Veterans Health Care and
Benefits Improvement Act of 2016, State Approving Agencies’ (SAAs)
authority to add additional approval criteria for approving either
accredited or nonaccredited programs designed to prepare an
individual for licensure and certification in a State, was modified
by requiring SAAs to consult with VA before imposing any additional
approval criteria, and requiring VA to make a determination about
such criteria. The new collection of information is contained in 38
CFR 21.4253(d)(10) and 21.4254(c)(15). These regulatory provisions
require that the SAA present a written proposal to VA that
justifies the need for the additional criteria. The information
will be used by VA to determine if the additional approval
requirement criteria, presented by an SAA, is necessary and
equitable to educational institutions offering programs designed to
prepare an individual for licensure and certification in a
State.
