The Family Reunification Packet for
Sponsors of Unaccompanied Children information collection contains
four instruments that allow ORR to collect information necessary to
determine the suitability of a proposed sponsor for an
unaccompanied child as required by the Homeland Security Act (6
U.S.C. 279), the Trafficking Victims Protection Reauthorization Act
of 2008 (8 U.S.C. 1232), and the Flores Settlement Agreement (No.
CV85-4544-RJK (C.D. Cal. 1996)). The collection was last approved
by OMB on May 19, 2021 and expires on June 30, 2022. ORR proposes
modifying the Authorization for Release of Information (Forms FRP-2
and FRP-2s) to ensure its compliance with the Stipulation and Order
of Settlement and Dismissal (“Settlement Agreement”) in Duchitanga
v. Huang (No. 18 Civ. 10332 (PAC) (KNF) (S.D. N.Y.), which was
executed and approved by the court on May 5, 2022. The proposed
changes incorporate language to fulfill ORR’s duty under Sections
3(c) and 4(d) of the Settlement Agreement to notify signees of its
obligation to make reasonable efforts to offer fingerprinting
appointments and process fingerprints in accordance with the
prescribed timelines. In addition, ORR proposes updating the
footnote on the first page of the form to cite the most recent
appropriations’ statute
