Dear Mr. Brammer:
The Federal Mine Safety and Health Review Commission (FMSHRC) is seeking renewal
of an Information Collection Request (ICR) entitled “Medical Exception Request Form” that was
originally approved by OIRA on November 30, 2021, for a period of 6 months.
In the event that mandatory COVID-19 vaccinations are reinstated for federal employees,
our agency is taking the requisite steps to renew the ICR so our employees may seek a legal
exception to the vaccination requirement due to a disability. Requests for “medical
accommodation” or “medical exceptions” will be treated as requests for a disability
accommodation and evaluated and decided under applicable Rehabilitation Act standards
for reasonable accommodation absent undue hardship to the agency. The agency will keep
confidential any medical information provided, subject to the applicable Rehabilitation Act
standards.
