This ICR addresses the information
collection activities that are contained in the final rule to add
natural gas processing (NGP) facilities to the scope of the
industrial sectors covered by the reporting requirements of section
313 of the Emergency Planning and Community Right-to-Know Act
(EPCRA), 42 U.S.C. section 11023, commonly known as the Toxics
Release Inventory (TRI). Estimated burden and costs associated with
the final rule are incremental to existing reporting burden for the
TRI Program overall, as documented in the TRI Form R and Form A
Toxic Chemical Release Reporting ICR Supporting Statement (Docket
ID# EPA-HQ-OPPT-2020-0078). Under the Paperwork Reduction Act
(PRA), 44 U.S.C. 3501 et seq., an agency may not conduct or
sponsor, and a person is not required to respond to, a collection
of information, unless it displays a currently valid control number
issued by the Office of Management and Budget (OMB). The OMB
control numbers are displayed either by publication in the Federal
Register or by other appropriate means, such as on the related
collection instrument or form, if applicable. The display of OMB
control numbers for certain EPA regulations is consolidated in 40
CFR part 9. Currently, facilities subject to the TRI reporting
requirements may use either the EPA Toxics Release Inventory Form R
(EPA Form No. 9350-1), or, if they meet alternate threshold
requirements, the EPA Toxics Release Inventory Form A Certification
Statement (simply referred to as “Form A” - EPA Form No. 9350-2).
With Form R, a facility reports one chemical per form; with Form A,
a facility may report multiple chemicals per form.
