Annual Firearms Manufacturing and Exportation Report
Under 18 U.S.C. Chapter 44, Firearms ATF Form 5300.11
A. Justification
1. The Annual Firearms Manufacturing and Exportation Report (AFMER) is used to collect
and disseminate data regarding firearms produced and sold or exported by licensed
manufacturers. The AFMER also provides the public with firearms production data
obtained from licensed manufacturers throughout the United States. The collected
information can be used for government and scholarly research and by other industries.
Under the Gun Control Act (GCA) 18 U.S.C§923(g)(5)(A), all licensed manufacturers are
required to complete and return the Annual Firearms Manufacturing and Exportation
Report Under 18 U.S.C. Chapter 44, Firearms - ATF Form 5300.11 to ATF, before April
1 of each year. Specifically, 18 U.S.C. § 923(g)(5)(A) mandates that: “Each licensee
shall, when required by letter issued by the Attorney General, and until notified to the
contrary in writing by the Attorney General, submit on a form specified by the Attorney
General, for periods and at the times specified in such letter, all record information
required to be kept by this chapter or such lesser record information as the Attorney
General in such letter may specify.”
2. AFMER is compiled from data submitted by licensed manufacturers on ATF Form
5300.11. The collected data is tabulated and then posted on the ATF public website.
The AFMER can be downloaded and used in diverse publications and presentations,
and market research about US firearm trends.
3. ATF Form 5300.11 is mailed directly to all type 07 and type 10 licensed manufactures for
mandatory completion. ATF Form 5300.11 is also available fully electronic, and can be
completed, signed, submitted electronically for processing, via the ATF’s eForms platform.
4. ATF uses a uniform subject classification system to identify duplication, and to ensure
that any similar information already available cannot be used or modified for the purpose
of this information collection.
5. The collection of information has no significant impact on small businesses or other
small entities. All licensed manufacturers, despite size, are required by law to report their
information.
6. Firearms research would be negatively impacted without the AFMER. This is because the
collected data allows tracking and assessments of the US firearms manufacturing industry.
Additionally, 18 U.S.C. § 923(g)(5)(A), authorizes ATF to collect specific firearms
information. Absence of this collection would eliminate ATF’s ability to enforce this
statute.

7. This information collection and record keeping requirement is conducted in a
manner consistent with 5 CFR 1320.6.
8. No public comments were received during the 60-day Federal Register notice period.
However, a 30-day notice will be published in the Federal Register to solicit public
comments.
9. No payment or gift to respondents is associated with collection of this information.
10. Confidentiality is not assured.
11. No questions of a sensitive nature are associated with this information collection.
12. There are 13,600 respondents associated with this information collection. Each respondent
completes the form once a year. Therefore, the total responses is also 13,600. It takes each
respondent approximately 20 minutes (.333) to complete the form. The total public burden
for this information collection is 4,533 hours. Hard copy AFMER forms are scanned and
stored in ECM (our electronic records management system). The original forms are
destroyed once scanned. Electronically submitted AFMER forms are stored in the eForms
system.
13. All respondents can electronically submit the AFMER to ATF free of charge.
14. The estimated annual Federal Government cost to produce/print/send form can be calculated
as follows:

15. The increase in respondents from 12,000 during the last renewal in 2017, to 13,600
currently, is due to more licensed manufacturers. All Federal Firearms Licensees (FFLs)
who possess a Type 07 (manufacturer of firearms) or Type 10 (manufacturer of
destructive devices) license must file an AFMER annually. The increase in burden hours
from 4,000 to 4,533 is also due to more licensed manufacturers.
16. The result of this collection will be posted on the ATF public website.
17. ATF does not request authorization to not display the OMB approval expiration date
for this information collection.
18. There are no exceptions to the certification statement.
