The previous terms of clearance still apply: OMB approves this emergency information collection request for a period of six months. Given ED's inability to seek public comment in advance due to the urgent nature of CARES Act implementation, ED requests a waiver from the requirement to publish notice in the Federal Register seeking public comment during the period of OMB review. ED will solicit public comment within a reasonable period, but not later than May 30, 2020.

Under the Elementary and Secondary School Emergency Relief Fund (ESSER Fund), the Department awards grants to State educational agencies (SEAs) for the purpose of providing local educational agencies (LEAs), including charter schools that are LEAs, with emergency relief funds to address the impact that Novel Coronavirus Disease 2019 (COVID-19) has had, and continues to have, on elementary and secondary schools across the nation. LEAs must provide equitable services to students and teachers in non-public schools as required under the Coronavirus Aid, Relief, and Economic Security Act (CARES Act).
Section 18003(a) of the CARES Act states that “the Secretary of Education shall issue a notice inviting applications not later than 30 days of enactment of this Act and shall approve or deny applications not later than 30 days after receipt” to enable State educational agencies to apply for funds made available by the CARES Act. ED is requesting an emergency clearance to provide emergency support to State Education Agencies and carry out the requirements of the CARES Act.
