OMB Clearance and PRA Burden Statement
The Paperwork Reduction Act (PRA) of 1995 requires Federal agencies to obtain Office of Management and Budget approval
before requesting most types of information from the public. When OMB approves an agency request to collect information from
the public, OMB (i) provides a valid OMB Control Number and expiration date for the agency to display on the instrument that will
be used to collect the information and (ii) requires the agency to inform the public about the OMB Control Number’s legal
significance in accordance with 5 CFR 1320.5(b).
The Office has requested and obtained OMB approvals for information it collects through the EFS-Web screens. Valid OMB
control numbers and expiration dates, as well as PRA burden statements and information about the OMB Control Numbers’ legal
significance, for each of the PDF-based ePetitions submitted through EFS-Web are displayed directly on the corresponding PDFbased ePetition forms. However, EFS-Web based ePetitions submitted through EFS-Web do not have a corresponding PDFbased ePetition form on which the required information can be displayed. The following information is thus provided for the EFSWeb based ePetitions submitted through EFS-Web.
For the EFS-Web based ePetition titled “Request for Withdrawal as Attorney or Agent of Record (37 CFR 1.36),” the OMB Control
Number is 0651-0035, and OMB’s current approval is valid through November 30, 2011. The information being collected is
required for the public to obtain or retain the benefit provided for in 37 CFR 1.36. The collection of information is estimated to take
12 minutes to complete, including gathering, preparing, and submitting the information to the USPTO.
For the EFS-Web based ePetitions titled “Petition to Withdraw from Issue After Payment of the Issue Fee (37 CFR 1.313(c)(1) or
(2)),” “Petition to Withdraw from Issue After Payment of the Issue Fee (37 CFR 1.313(c)(1) or (2) with Assigned Patent Number),”
“Petition to Withdraw from Issue After Payment of the Issue Fee (37 CFR 1.313(c)(3)),”and “Petition to Withdraw from Issue After
Payment of the Issue Fee (37 CFR 1.313(c)(3) with Assigned Patent Number),”, the OMB Control Number is 0651-0059, and
OMB’s current approval is valid through July 31, 2014. The information being collected is required for the public to obtain or retain
the benefit provided for in 37 CFR 1.313. The collection of information is estimated to take 1 hour to complete, including gathering,
preparing, and submitting the information to the USPTO.
For the EFS-Web based ePetitions titled “Petition to Accept Late Payment of Issue Fee - Unintentional Late Payment (37 CFR
1.137(b)),” “Petition for Revival of an Application based on Failure to Notify the Office of a Foreign or International Filing (37 CFR
1.137(f)),” and “Petition for Revival of an Application for Continuity Purposes Only (37 CFR 1.137(b)),” the OMB Control Number is
0651-0031, and OMB’s current approval is valid through July 31, 2012. The information being collected is required for the public to
obtain or retain the benefit provided for in 37 CFR 1.137. The collection of information is estimated to take 1.0 hour to complete,
including gathering, preparing, and submitting the information to the USPTO.
Under the Paperwork Reduction Act of 1995, no persons are required to respond to a collection of information unless it displays a
valid OMB control number. The confidentiality of all information collected is governed by 35 U.S.C. 122 and 37 CFR 1.11 and 1.14.
Although estimates have been provided for the time to complete each form, time will vary depending upon the individual case. Any
comments on the amount of time required to submit the information being collected and/or suggestions for reducing the burden of
