Addendum to Declaration for Federal Employment, Child Care and Indian Child Care Worker Positions (OMB No. 0917 – 0028)

Background:
This is a request for approval of an extension for an information collection required by section 408 of the Indian Child Protection and Family Violence Prevention Act (herein referred to as the “Act”), Public Law (Pub. L.) 101-630 [104 Statutes at Large (Stat.) 4544; 25 United States Code (U.S.C.) §§ 3201-3211], as amended by section 814 of Pub. L. 106-568, the Technical Amendment to the “Act”.
B. COLLECTION OF INFORMATION EMPLOYING STATISTICAL METHODS
Statistical methods are not used in this collection.
The “Addendum to Declaration for Federal Employment, Child Care and Indian Child Care Worker Positions” (OMB No. 0917-0028) form is attached to an individual’s application for a Federal position in the Indian Health Service (IHS), if the advertised position is designated as having any contact with or control over Indian children. The questions are derived from the Indian Child Protection and Family Violence Prevention Act (Pub. L. 101-630), and the Crime Control Act of 1990 (Pub. L. 101-647). An individual may only provide a “Yes” or “No” answer to the following two questions, on the form:
Have you ever been arrested or charged with a crime involving a child and
Have you ever having been found guilty of, or entered a “no contest” plea to any felonious or misdemeanor offense involving crimes against persons or offense involving crimes of violence, sexual assault, molestation, crimes against persons or offenses committed against children.
Any “yes” answer to question #1 does not automatically disqualify an applicant but does raise eligibility issues. The Agency will evaluate the appropriate information in order to make an eligibility determination before further action can be taken on the application.
Any “yes” answer to question #2 will disqualify the applicant from further consideration for the position.
A “no” response to both question #1 and #2 will allow further consideration of the applicant, pending formal background checks if selected.
No statistical methods are employed to evaluate the information received. Federal human resources specialists who review all employment applications will review responses to either disqualify the applicant from consideration or continue with the evaluation process of the application as with all the other qualified applicants.

Public Burden Statement: In accordance with Paperwork Reduction Act (5 C.F.R. 1320.8 (b)(3), a Federal agency may not conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number. Respondents must be informed (on the reporting instrument, in instructions, or in a cover letter) the reasons for which the information will be collected; the way the information will be used to further the proper performance of the functions of the agency; whether responses to the collection of the information are voluntary, required to obtain a benefit (citing authority), or mandatory (citing authority); and the nature and extent of confidentiality to be provided, if any (citing authority). Public reporting burden for this collection of information is estimated to average 5 minutes per response, including time for reviewing instructions, searching existing data sources, gathering and maintaining the necessary data, and completing and reviewing the collection information.
