SUPPORTING STATEMENT


A. Justification:


The Commission is requesting the Office of Management and Budget (OMB) approval for a renewal of this information collection.


1. Background. Section 90.176 requires each Private Land Mobile frequency coordinator to provide, within one business day, a listing of their frequency recommendations to all other frequency coordinators in their respective pool, and, if requested, an engineering analysis. Any method can be used to ensure this compliance with the “one business day requirement” and must provide, at a minimum, the name of the applicant; frequency or frequencies recommended; antenna locations and heights; the effective radiated power; the type(s) of emissions; the description of the service area; and the date and time of the recommendation. If a conflict in recommendations arises, the affected coordnators are jointly responsible for taking action to resolve the conflict, up to and including notifying the Commission that an application may have to be returned.


Statutory authority for this collection of information is contained in Sections 4(i), 11, 303(g), 303(r), and 332(c)(7) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 161, 303(g), 303(r), 332(c)(7) unless otherwise noted.


This information collection does not affect individuals or households; thus, there are no impacts under the Privacy Act.


  1. This requirement seeks to avoid situations where harmful interference is created because two or more coordinators recommend the same frequency in the same area at approximately the same time to different applicants.


  1. Prior to finalizing rulemakings the Public Safety and Homeland Security and Wireless Telecommunications Bureaus conduct an analysis to insure that improved information technology cannot be used to reduce the burden on the public. This analysis considers the possibility of obtaining and/or computer‑generating the required data from existing data bases in the Commission or other federal agencies.


The information is shared electronically reducing the burden to effected entities and minimizing the time required to disperse the information. The electronic method used is agreed upon by the reporting entities.



  1. This agency does not impose a similar information collection on the respondents. There are no similar data available.


  1. In conformance with the Paperwork Reduction Act of 1995, the Commission is making an effort to minimize the burden on all respondents, regardless of size. The Commission has limited the information requirements to those absolutely necessary for evaluating and processing each application and to deter against possible abuses of the processes.


  1. This information is collected only once—when the frequency coordinators arrive at consensus concerning which entity is to receive which frequency(s). Accordingly, less frequent collections are not feasible.


  1. Current data collection is consistent with 5 CFR Section 1320.5(d)(2).


  1. The Commission published a 60-day notice to solicit public comment which appeared in the Federal Register September 12, 2017 (82 FR 42809). No comments were received as a result of this notice.


  1. Respondents will not receive any gifts or payments.


  1. There is no need for confidentiality.


  1. There are no requests of a sensitive nature considered or those considered a private matter being sought from the applicants on this collection.


  1. The information is required daily from each frequency coordinator.


Approximately 13 Private Land Mobile frequency coordinators will be subject to fulfilling this requirement.


13 coordinators x 5 business days/week x 52 weeks/year = 3,380 responses


Although the R&O has added the 1400 MHz frequency bands to those that the frequency coordinators must address, we estimate that the time required resolving these frequency coordination issues will remain 0.5 hours.


Approximately 13 Privacy Land Mobile frequency coordinators will take 0.5 hours daily to respond to these coordination efforts. These coordination efforts will occur, on average each business day, every week of the year.

  1. The Commission is reporting adjustments/decreases to this collection since the last submission to OMB. There is a decrease in the total number of respondents from 15 to 13

(-2), total annual responses decreased from 3,900 to 3,380 (-520) and the total annual burden hours decreased from 1,950 to 1,690 (-260). These adjustments/decreases to this collection reflect a decrease in the number of transactions being reported from the last submission to OMB.


  1. The data will not be published for statistical use.


  1. We do not seek approval to not display the expiration date for OMB approval of the information collection.


  1. There are no exceptions to the Certification Statement.
