NOTICE DENYING EXTENSION OF TIME

(October 11, 2017)

On October 3, 2017, the Advanced Energy Economy, American Biogas Council, American Council on Renewable Energy, American Petroleum Institute, American Public Power Association, American Wind Energy Association, Business Council for Sustainable Energy, Electric Power Supply Association, Electricity Consumers Resource Council, Energy Storage Association, Interstate Natural Gas Association of America, National Rural Electric Cooperative Association, Natural Gas Supply Association, and Solar Energy Industries Association (collectively, Energy Industry Associations) filed a joint motion for an extension of time to file comments in response to a rule proposed by the Secretary of Energy for final action by the Federal Energy Regulatory Commission (Commission).¹ On October 5, 2017, Independent Producers² filed a joint motion for extension of time to file comments. Energy Industry Associations and Independent Producers request that the Commission provide a 90 day initial comment period and a 45 day reply comment period, such that initial comments would be due on or before January 2, 2018, and reply comments would be due on or before February 16, 2018. Energy Industry Associations state that the extension of time would allow for meaningful public input from all stakeholders and would provide the Commission with more detailed and carefully considered comments. Also on October 5, 2017, Industrial Energy Consumers of America filed a comment requesting a 90 day initial comment period.³

Upon consideration, the motions of the Energy Industry Associations, Independent Producers, and Industrial Energy Consumers of America for extension of time to file comments are hereby denied. Comments on the Proposal are due on or before October 23, 2017 and reply comments are due on or before November 7, 2017.
