Emergency Clearance for Implementation of Revised Confidentiality Pledge

The Federal Cybersecurity Enhancement Act of 2015 (H.R. 2029, Division N, Title II, Subtitle
B, Sec. 223) mandates that Federal information systems be protected from malicious activities
through cybersecurity screening of transmitted data.-ln response to the mandatory
implementation of cybersecurity screening, the National Center for Health Statistics (NCHS) is
submitting this Information Collection Request (ICR) to the Office of Management and Budget
(0MB) utilizing emergency review procedures in accordance with the Paperwork Reduction Act
(PRA) (P.L. 104-13, 44 U.S.C. Chapter 35) and 5 C.F.R. Section 1320.13.
NCHS is seeking emergency clearance for the collections listed below to implement a change to
the confidentiality pledge in response to the mandatory implementation of cybersecurity
screening of transmitted data by the Department of Homeland Security.
NCHS is requesting 0MB approval to include the lines in bold to its confidentiality pledge to
notify respondents of the new cybersecurity screening activities:
We take your privacy very seriously. All information that relates to or describes
identifiable characteristics of individuals, a practice, or an establishment will be used
only for statistical purposes. NCHS staff, contractors, and agents will not disclose or
release responses in identifiable form without the consent ofthe individual or
establishment in accordance with section 308(d) of the Public Health Service Act (./2USC
242m) and the Confidential Information Protection and Statistical Efficiency Act of 2002
(CIPSEA, Title 5 of Public Law 107-347). In accordance with CIPSEA, every NCHS
employee, contractor, and agent has taken an oath and is subject to a jail term of up to
five years, a fine of up to $250,000, or both if he or she willfully discloses ANY
identifiable information about you. In addition, NCHS complies wit/, tl,e Federal
Cybersecurity E11/1a11cement Act of 2015. Tl,is law requires tl,e federal governme11t to
protectfederal computer 11etworks by usi11g computer security programs to identify
cybersecurity risks like l,acki11g, i11temet attacks, a11d otlter security weak11esses. If
informatio11 sent tltrougl, govemme11t 11eh'1orks triggers a cyber tltreat i11dicator, t/,e
informatio11 may be intercepted and reviewed for cyber tltreats by computer 11eh'1ork
experts working/or, or 011 bel,alf, of tl,e governme11t.

NCHS has consulted with 0MB on this request and has 0MB approval to initiate the emergency
request process. NCHS also plans to submit an information collection request (ICR) seeking
public comment on the revised pledge language. This ICR will be submitted to 0MB under the
standard clearance process to provide the public with another opportunity to comment on the
revised language.
