The information collected is used by FRA to ensure that railroads/track owners adopt and implement bridge management programs as required by the Rail Safety Improvement Act of 2008 and this regulation in order to properly inspect, maintain, modify, and repair all bridges that carry trains over them for which they are responsible. Additionally, as a result of Section 11405 of the FAST Act, FRA has developed a new Form (FRA F 6180.167) titled “Bridge Inspection Report Public Version Request Form”, which will be used by the agency to facilitate requests by States and their political subdivisions for these bridge inspection reports. FRA will use the information provided by States/their political subdivisions to identify the bridge (e.g., street name, waterway, other identifiable land feature, etc.) and the requester seeking a public version of the most recent bridge inspection report.. FRA will then require railroads to provide a public version of the requested report so that it can be sent to the State or political subdivision to be used by them to ascertain the status of that bridge and take any needed measures to continue to ensure public safety.
FRA is requesting Emergency processing approval seven (7) days after publication of the required Notice in the Federal Register on February 19, 2016, see 81 FR 8588. FRA cannot reasonably comply with normal clearance procedures because they would likely disrupt the collection of information. Under the FAST Act (Section 11405), a State or political subdivision of a State may file a request with the Secretary of Transportation (as delegated to FRA under 49 CFR 1.89) for a public version of a bridge inspection report. If FRA determines that the request is reasonable, FRA “shall require the railroad to submit a public version of the most recent bridge inspection report.” Under the Act, FRA must provide to the State or any political subdivision of a State a public version of the report submitted by the railroad. FRA expects States and their political subdivisions to immediately request a public version of bridge inspection reports that affect critical infrastructure within their jurisdiction to ensure public safety. Upon receipt of such requests, FRA will require railroads to submit to the agency a public version of the most recent bridge inspection report. In order to promptly furnish the required report to States/their political subdivisions and to ensure continued public safety, FRA is requesting OMB approval on or before February 26, 2016.

The burden for this information collection has increased by 81 hours from the last submission. The increase in burden is solely the result of FAST Act program changes, which are completely delineated in the table provided in the answer to question number 15 of the attached Supporting Justification. Total program changes shown in the table provided increased the burden by 81 hours and increased the number of responses by 150. The current OMB inventory for this information collection shows a total burden of 224,608 hours, while the present submission exhibits a total burden of 224,689 hours. Hence, there is a burden increase of 81 hours. There is no change in cost to respondents from the previous submission. ***NOTE: Once Emergency Clearance is granted by OMB, FRA will submit an amended Supporting Justification/amended information collection request under Regular Clearance procedures.
