Counterfeiting affects governments,
businesses and consumers throughout the supply chain. Growing
concerns regarding counterfeit parts led to the enactment of
Section 818 of the National Defense Authorization Act (NDAA) for
Fiscal Year (FY) Fiscal Year 2012, requiring regulations regarding
the definition, prevention, detection, and reporting of actual or
suspected counterfeit items in the Government-Industry Data
Exchange Program (GIDEP) system. While section 818 was directed
specifically at the Department of Defense (DoD), the Administration
considers the problem of counterfeit parts to be significant across
the Federal Government. Therefore, the paperwork requirement will
impact all Federal agencies. Additionally, further guidance is
given in the Office of Federal Procurement Policy (OFPP) Letter
91-3, Reporting Nonconforming Products, directing Federal agencies
to report nonconforming products. Combined, the goal of reporting
counterfeit and suspect counterfeit items into GIDEP is to avoid,
detect and address counterfeit parts in the supply chain.
