The information will be used for
monitoring and evaluating tribal child support enforcement
programs.
The, ACF, Office of
Child Support Enforcement (OCSE) is requesting to use emergency
procedures to extend the use of the OCSE-75 that expired July 31,
2013 for 180 days, until January 27, 2014. A revised OCSE-75 was
recently approved on 8/19/2013, with an expiration date of
8/31/2016. This new version of the form has significant changes.
There is not sufficient time for the affected tribes to make the
significant changes needed to use this revised form to report FY
2013 data. Tribes can begin submitting their FY2013 reports anytime
after September 30, 2013, but no later than 12-29-2013. OCSE did
not anticipate that it would take so long to revise the form based
on tribal meetings and consultation and now there is not sufficient
time for the tribes to reprogram their systems to capture these
data for FY 2013 which ends September 30, 2013. Therefore, OCSE
needs to continue the use of the previously approved form instead
of the recently approved revised form. In 2012, OCSE met with
Tribal IV-D Directors in March, June, and July to discuss proposed
changes to the OCSE-75 form and instructions. In October 2012, OCSE
initiated a written consultation with Tribal IV-D Leaders followed
by a second written consultation in January 2013 to discuss
comments initially received. In April 2013, there were two
conference calls held with Tribal IV-D Directors to finalize
proposed changes to the OCCSE-75 form and instructions. OCSE spent
over a year working with the tribes to finalize the changes to the
reporting form prior to beginning the formal PRA process. Attached
are communication documents with the tribes regarding these
discussions. The changes to the form involve reporting total cases
and children open at any time during the fiscal year. The current
form only requires tribes to report cases and children open as of
September 30. It will take time for tribes to change their systems
to report these new data. The new form also requires changes to the
way that paternities established and collections are reported. In
addition, several new reporting lines were added to the report that
tribes felt would better reflect their performance. It will take
time for tribes to change their systems to capture this additional
information. Based on the set of circumstances described above, ACF
requests approval to use emergency processing procedures to
continue using the previously approved form due to an unanticipated
event (CFR 1320.13(a)(2)(ii)). Approval is requested by September
30, 2013.
