SUPPPORTING STATEMENT FOR

PAPERWORK REDUCTION ACT SUBMISSION

Information Collection 9000-0161,

Reporting of Purchases from Outside the United States


A. Justification


1. Administrative requirements. The Federal Acquisition Regulation (FAR) 52.225-18, Place of Manufacture, requires offerors of manufactured end products to provide information as to whether the offered end products are predominantly manufactured in the United States or outside the United States.

2. Use of information. The information provided in accordance with the provision at FAR 52.225-18, Place of Manufacture, is used by contracting officers as the basis for entry into the Federal Procurement Data System (FPDS) for further data on the rationale for purchasing foreign manufactured items.


3. Consideration of information technology. Improved information technology is used to the maximum extend practicable. Where both the Government agency and contractors are capable of electronic interchange, the contractors may submit this information collection requirement electronically.


4. Efforts to identify duplication. This requirement is being issued under the Federal Acquisition Regulation (FAR) which has been developed to standardize Federal procurement practices and eliminate unnecessary duplication. This collection is not duplicative of any other information required from offerors.


5. If the collection of information impacts small businesses or other entities, describe methods used to minimize burden.
The burden applied to small businesses is the minimum consistent with applicable laws, Executive Orders, regulations, and prudent business practices.


6. Describe consequence to Federal program or policy activities if the collection is not conducted less frequently. Similar information is not already available to the contracting officer in a standardized form.


7. Special circumstances for collection. The collection is fully consistent with guidelines in 5 CFR 1320.6.


8. Efforts to consult with persons outside the agency. A 60-day notice was published in the Federal Register at 78 FR 56230, on September 12, 2013 and no comments were received.


9. Explanation of any decision to provide any payment or gift to respondents other than reenumeration of contractors or guarantees. Not applicable.

10. Describe assurance of confidentiality provided to respondents. This information is disclosed only to the extent consistent with prudent business practices, and current regulations.


11. Additional justification for questions of a sensitive nature. No questions of a sensitive nature are involved.


12 & 13. Estimated total annual public hour burden. Based on a Federal Procurement Data System (FPDS) report of Government-wide acquisition of manufactured end products in FY 2012, a total of 427,055 contracts were awarded. Since this is a solicitation provision, we estimate an average of 4 responses per solicitation resulting in approximately 1,708,220 offers (427,055 x 4). Of the approximately 1,708,220 offers, the Government estimates that an average of 10 responses annually will be received from 170,822 unique vendors (1,708,220/10). Consequently, it was determined that the FY 2012 FPDS data identifying 170,822 unique vendors was a sufficient baseline for estimating the number of respondents. It is therefore estimated that approximately 170,822 respondents would need to comply with this information collection. The time required to read and prepare information is estimated at .01 hour (less than one minute) per completion. Recordkeeping will be integrated into systems already established by offerors.

14. Estimated Cost to the Government. Agencies will review and input the information into FPDS with the award of covered contracts. The contracting officer only inputs data into FPDS for contracts awarded, not for each solicitation response.

* We used a rate equivalent to a GS-12, Step 3 or $30.81/hour (from the 2012 OPM GS Salary Table), added overhead at 36.25 percent (the OMB-mandated burden rate for A-76 public-private competitions, rounded to 36%), and rounded the average wage to the nearest whole dollar, or $42/hour.

15. Explain reasons for program changes or adjustments reported in Item 13 or 14.

This decrease in the number of estimated responses and resultant burden hours is a result of the current data provided in FY 2012 FPDS. The information collection requirement in the FAR remains unchanged.


16. Outline plans for published results of information collections. Results will not be tabulated or published.


17. Approval not to display expiration date. Not applicable.


18. Explanation of exception to certification statement. Not applicable.


B. Collection of Information Employing Statistical Methods. Statistical methods are not used in this information collection.
