This proposed information collection is part of a supplemental proposed rule that would revise the BLM's management of hydraulic fracturing on Federal and Indian lands. The supplemental proposed rule is a revision of a proposed rule published on May 11, 2012. In connection with the initial proposed rule, OMB assigned a control number (1004-0203), and issued a Notice of Action directing the BLM to address public comments pertaining to the information collection activities proposed therein. Both the initial and supplemental proposed rule include regulations that would provide for new uses and burdens for BLM Form 3160-5 (Sundry Notices and Reports on Wells). Form 3160-5 is approved under control number 1004-0137. Upon approval of another new control number for the new uses and burdens, and upon finalization of the supplemental proposed rule, the BLM intends to request merger of the new control number with control number 1004-0137.

The increased burdens associated with the program changes in the supplemental proposed rule are necessary in order to modernize the BLM's management of hydraulic fracturing operations. Such operations have changed in ways that were not anticipated when the existing collection requirements approved under control number 1004-0137 were developed, and will enable the BLM to ensure that operators are using best practices in fracturing operations; prevent unnecessary or undue degradation; and manage public lands using the principles of multiple use and sustained yield.
