instruments are clearly understood, and
OSHA’s estimate of the information
collection burden is accurate. The
Occupational Safety and Health Act of
1970 (the OSH Act) (29 U.S.C. 651 et
seq.) authorizes information collection
by employers as necessary or
appropriate for enforcement of the OSH
Act or for developing information
regarding the causes and prevention of
occupational injuries, illnesses, and
accidents (29 U.S.C. 657). The OSH Act
also requires that OSHA obtain such
information with minimum burden
upon employers, especially those
operating small businesses, and to
reduce to the maximum extent feasible
unnecessary duplication of efforts in
obtaining information (29 U.S.C. 657).
To meet many of OSHA’s program
needs, OSHA is proposing to continue
its collection of occupational injury and
illness data and information on the
number of workers employed and the
number of hours worked from
establishments in portions of the private
sector and from some state and local
government agencies. OSHA will collect
the data on an annual basis from up to
100,000 employers already required to
create and maintain records pursuant to
29 CFR part 1904. These data will allow
OSHA to calculate occupational injury
and illness rates and to focus its efforts
on individual workplaces with ongoing
serious safety and health problems.
Successful implementation of this data
collection is critical to OSHA’s outreach
and enforcement efforts and the data
requirements tied to the Government
Performance and Results Act (GPRA).

II. Special Issues for Comment
Public comment is invited on all
issues raised by this Federal Register
Notice. OSHA has a particular interest
in comments on the following issues:
• Whether the proposed information
collection requirements are necessary
for the proper performance of the
Agency’s functions, including whether
the information is useful;
• The accuracy of OSHA’s estimate of
the burden (time and costs) of the
information collection requirements,
including the validity of the
methodology and assumptions used;
• The quality, utility, and clarity of
the information collected; and
• Ways to minimize the burden on
employers who must comply; for
example, by using automated or other
technological information collection
and transmission techniques.

Proposed Extension of the Approval of
Information Collection Requirements

ACTION:

Notice.

The Department of Labor, as
part of its continuing effort to reduce
paperwork and respondent burden,
conducts a preclearance consultation
program to provide the general public
and Federal agencies with an
opportunity to comment on proposed
and/or continuing collections of
information in accordance with the
Paperwork Reduction Act of 1995
(PRA95). 44 U.S.C. 3056(c)(2)(A). This
program helps to ensure that requested
data can be provided in the desired
format, reporting burden (time and
financial resources) is minimized,
collection instruments are clearly
understood, and the impact of collection
requirements on respondents can be
properly assessed. Currently, the Wage
and Hour Division is soliciting
comments concerning its proposal to
extend Office of Management and
Budget (OMB) approval of the
Information Collection: Work-Study
Program of the Child Labor Regulations
(WSP) Regulations 29 CFR Section

SUPPLEMENTARY INFORMATION:
I. Background
The Wage and Hour Division of the
Department of Labor administers the
Fair Labor Standards Act. Section 3(l) of
the Act establishes a minimum age of 16
years for most nonagricultural
employment, but allows the
employment of 14- and 15-year-olds in
occupations other than manufacturing
and mining if the Secretary of Labor
determines such employment is
confined to: (1) Periods that will not
interfere with the minor’s schooling;
and (2) conditions that will not interfere
with the minor’s health and well-being.
FLSA section 11(c) requires all covered

employers to make, keep, and preserve
records of their employees’ wages,
hours, and other conditions and
practices of employment. Section 11(c)
authorizes the Secretary of Labor to
prescribe the recordkeeping and
reporting requirements for these
records. The regulations set forth
reporting requirements that include a
Work Study Program application and
written participation agreement. In
order to utilize the child labor work
study provisions, § 570.35(b) requires a
local public or private school system to
file with the Wage and Hour Division
Administrator an application for
approval of a Work Study Program as
one that does not interfere with the
schooling or health and well-being of
the minors involved. The regulations
also require preparation of a written
participation agreement for each student
participating in a Work Study Program
and that the teacher-coordinator,
employer and student each sign that
agreement.
II. Review Focus
The Department of Labor is
particularly interested in comments
which:
• Evaluate whether the proposed
collection of information is necessary
for the proper performance of the
functions of the agency, including
whether the information will have
practical utility;
• Enhance the quality, utility, and
clarity of the information to be
collected;
• Evaluate the accuracy of the
agency’s estimate of the burden of the
proposed collection of information,
including the validity of the
methodology and assumptions used;
• Minimize the burden of the
collection of information on those who
are to respond, including through the
use of appropriate automated,
electronic, mechanical, or other
technological collection techniques or
other forms of information technology,
e.g., permitting electronic submissions
of responses.
III. Current Actions
The Department of Labor seeks an
approval for the extension of this
information collection that requires the
submission of an application and
approval of a Work Study Program and
completion and submission of a written
participation agreement in accordance
with statutory and regulatory
requirements.
