Dear Permit Holder:


Your application to fish for lobster with traps in Lobster Conservation Management Area 2 (LCMA) and the Outer Cape LCMA for your vessel, F/V Vessel Name, Federal permit number ######, has been received. Upon review of your application, it was determined that your vessel is ineligible to participate in the lobster trap fishery in LCMA [insert area or areas].


If you believe our assessment of your qualification(s) is incorrect, you may appeal in writing to the Regional Administrator within 45 days of the date on this denial letter. You must also provide all necessary documentation to demonstrate your qualification for the Area 2 and/or Outer Cape Effort Control Plan.


You may be eligible for a Director’s Appeal if you were qualified for entry to Area 2 and/or the Outer Cape by your state fisheries agency. Follow the attached instructions for pursuing a Director’s Appeal (to reviewers – we will know this ahead of time so this letter will be tailored to the specific type of appeal).
