In accordance
with 5 CFR 1320.11, OMB is filing the following comments on this
proposed information collection: DOJ is reminded that 5 CFR 1320.11
requires it to submit ICRs associated with proposed rules "not
later than the day on which the NPRM is published in the Federal
Register." DOJ did not do this in this case. Before submitting the
final version of this ICR to OMB for review, DOJ should ensure that
its time and cost burden estimates are accurate, consistent in the
supporting statement and ROCIS, and that its methodology is clear.
DOJ should ensure that the abstract for the final ICR addresses
what the collection is instead of a general description of the
rule. Before submitting a final version of this collection to OMB
for review, DOJ should consult its privay office for any privacy
issues raised by this collection. DOJ should include in the final
rule's preamble a summary of the comments it receives in response
to the proposed collection of information in the NPRM and a
response to those comments, including any changes to the collection
because of comments or reasons why comments were not adopted.

The Department of Justice plans to
propose amendments to title 28 of the Code of Federal Regulations,
part 25 to promote public safety, to enhance the efficiency of the
National Instant Criminal Background Check System (NICS)
operations, and to resolve difficulties created by unforeseen
processing conflicts within the system. The proposed amendments
would address entities authorized to receive information in
connection with the issuance of a firearm-related permit or
license; (2) access to the FBI-maintained NICS Index to permit
background checks for the purpose of returning firearms in the
possession of a law enforcement or criminal justice agency; and (3)
requirements for retention of records relating to denied
transactions.
