Guam-CNMI Visa Waiver Agreement

(Form I-760)

  1. Justification.

  1. Why is this information collection necessary?


Carriers are responsible for ensuring that every alien transported to Guam and/or the Commonwealth of the Northern Mariana Islands (CNMI) pursuant to Public Law 110-229 under the Guam-CNMI Visa Waiver Program meets all of the eligibility criteria prior to departure to Guam and/or the CNMI.  See 8 CFR 212.1(q).  Carriers are liable and subject to fine, pursuant to section 273 of the Immigration and Nationality Act (INA) (8 U.S.C. 1323), for transporting to the United States any alien who does not have a valid passport and an unexpired visa, if a visa was required.  Any transportation line bringing any alien to Guam and/or the CNMI under the Guam-CNMI Visa Waiver Program must enter into an agreement with CBP on Form I-760.  This form is accessible at http://forms.cbp.gov/pdf/CBP_Form_i760.pdf.


  1. For what purpose is the information collection to be used?


The information collected helps ensure that carriers exercise diligence in transporting only eligible aliens.


  1. Does this collection of information involve the use of automation or technology?


It would not be efficient to automate this form because there are only a small number of respondents and very few, if any, new forms filed.


  1. Describe efforts to identify duplication.


This information is not duplicated in any other place or any other form.


  1. Describe efforts to minimize the impact of this information collection on small entities.


This collection of information does not have an impact on small businesses or other small entities.


  1. What are the consequences if this information were collected less frequently?


CBP needs this information to ensure that carriers exercise diligence in transporting only eligible aliens. It is only collected once from each carrier.


  1. Explain any special circumstances.


There are no special circumstances applicable to this information collection.


  1. Public comments.


Public comments were solicited through two Federal Register notices published on February 7, 2012 (Volume 77, Page 6137) on which no comments were received, and on April 10, 2012 (Volume 77, Page 21578) on which no comments have been received.


  1. Payment or gifts.


The CBP does not provide payment or gifts to respondents in exchange for a benefit sought.


  1. Assurance or confidentiality.


There is no PII associated with this collection of information. No assurances of confidentiality are made to respondents.


  1. Are there questions of a sensitive nature?


There are no questions of a sensitive nature.

Public Cost


The estimated cost to the respondents is $450.00. This is based on the estimated burden hours (6) multiplied (x) hourly rate ($75.00).

There are no capital or start-up costs associated with this information collection.



14. Government Cost


The estimated cost of the program to the Government is $326. This figure is calculated by using the number of respondents (31) multiplied by time required to collect and process information (.25 hours) = 7.75 x multiplied (x) by the estimated average hourly rate ($42) = $326.


15. Change in Burden Hours.


The number of responses was increased from 10 to 31 because there are currently 31 signatories to this Agreement. When the CNMI was added in 2009, more carriers (respondents) signed this Agreement than CBP anticipated. However, no new carriers have signed this Agreement in the past few years. There are no changes to the information collected or to CBP Form I-760.


16. For collection of information whose results will be published, outline plans for tabulation, and publication.


This information collection will not be published.


17. If seeking approval to not display the expiration date for OMB approval of the information collection, explain the reasons that display would be appropriate.


CBP is not seeking approval to not display the expiration date.
