Summary of Changes
IRM 3.21.262.6.1(3) has been revised to state that the identification documents submitted with Form 8946 must
include at least one document that contains a photograph of the applicant. We addressed this in the "What's New"
section and the "How To Apply" section.
Under "Telephone Help", we updated the phone number for international callers, as the number has changed.
Under "Applying by Computer", we updated the webpage address, as the webpage address has changed.
We received a comment from IRS counsel instructing us to delete the phrase "Privacy Act" and certain sentences
appearing in what was previously called the "Privacy Act and Paperwork Reduction Act Notice" (the deletions are
shown on the attached document). The reason the deletion was requested is the following: The Privacy Act defines
"individual" as "a citizen of the United States or an alien lawfully admitted for permanent residence. 5 U.S.C. section
552a(a)(2). Only persons who are neither a citizen of the United States nor an alien lawfully admitted for permanent
residence can submit Form 8946. Therefore, Form 8946 cannot be completed by an "individual" as defined by the
Privacy Act. Because Form 8946 cannot be completed by an individual, as defined by the Privacy Act, a Privacy Act
Notice is not required.
