SUPPORTING STATEMENT




  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


This notice provides guidance to Missouri housing credit agencies regarding the suspension of certain income limitation requirements under section 42 of the Internal Revenue Code for certain low-income housing tax credit properties as a result of the devastation caused by severe storms, tornadoes and flooding in Missouri.


  1. USE OF DATA


This information will be used to enable the Service and the Missouri housing credit agencies to verify whether displaced individuals warrant temporary housing in vacant low-income housing credit projects in accordance with existing requirements under section 42 of the Internal Revenue Code.

  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


IRS Publications, Regulations, Notices and Letters are to be electronically enabled on an as practicable basis in accordance with the IRS Reform and Restructuring Act of 1998.

The recordkeeping requirement is in requirement IV. (3) of the notice. This information is required so that the Service and the Missouri Housing Development Commission is able to verify whether displaced individuals warrant temporary housing in vacant low-income housing credit projects in accordance with existing requirements under section 42 of the Internal Revenue Code. The estimated annual burden per recordkeeper is 15 minutes. The estimated number of recordkeepers is 500. The estimated total annual recordkeeping burden is 125 hours.


Estimates of the annualized cost to respondents for the hour burdens shown are not available at this time.

  1. REASONS FOR CHANGE IN BURDEN


This is a new collection. The Internal Revenue Service is suspending certain requirements under § 42 of the Internal Revenue Code for low-income housing credit projects in the United States to provide emergency housing relief needed as a result of the devastation caused by severe storms, tornadoes and flooding in Missouri beginning on April 19, 2011. This relief is being granted pursuant to the Service’s authority under § 42(n) and § 1.42-13(a) of the Income Tax Regulations.

  1. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the notice sunsets as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.

REASON FOR EMERGENCY APPROVAL


The notice is effective May 9, 2011, the date of the President’s major disaster declarations as a result of the severe storms and flooding in Missouri beginning on April 19, 2011. Displaced and homeless individuals, property owners, and the Missouri Housing Development Commission urgently need the guidance in this notice. This notice provides guidance to Missouri housing credit agencies regarding the suspension of certain income limitation requirements under section 42 of the Internal Revenue Code for certain low-income housing tax credit properties as a result of the devastation caused by severe storms, tornadoes and flooding in Missouri. Missouri has informed us that until we publish a disaster relief notice, approximately 6,000 people will remain displaced because of the flooding, storms and tornadoes in MissouriIt results in a net increase of 125 burden hours.
