JUSTIFICATION FOR CHANGE

DFARS Part 225, Foreign Acquisition, and related contract clauses at DFARS 252.225.

Section 222 of the National Defense Authorization Act for Fiscal Year 2011 repealed the restriction on acquisition from foreign sources of Ballistic Missile Defense research, development, test, and evaluation. Therefore, we are deleting DFARS clause 252.225-7018, Notice of Prohibition of Certain Contracts with Foreign Entities for the Conduct of Ballistic Missile Defense Research, Development, Test, and Evaluation, from the DFARS.

The following shows the number of respondents, burden hours, and cost being deleted from DFARS collection 0704-0229:

This information collection requirement was included in our August 27, 2010, request for 3-year extension of the information collection requirement under OMB Control Number 0704-0229, DFARS Part 225, Foreign Acquisition, and related contract clauses at DFARS 252.225. This information collection requirement was previously approved under OMB Clearance No. 0704-0187 in the amount of 5 hours. This estimate was based on fiscal year 1996 DD Form 350 data indicating 182 RDT&E contracts for the BMD program in 1996, and an estimate of three responses per solicitation, five responses per respondent, and .01 hours per response. We did not propose any change to these estimates.
