Justification for No material/Nonsubstantive Change
The Department is hereby submitting a no material, nonsubstantive change request for OMB Control Number 1210-0116, the Form M-1, Annual Report for Multiple Employer Welfare Arrangements (MEWAs). The Department has issued the 2010 version of the Form M-1. This is an annual disclosure that MEWAs and certain Entities Claiming Exception (ECEs) file with the Department to report compliance with Part 7 of Title I of the ERISA. This year's Form M-1 is generally identical to the Year 2009 Form M-1, except that a few minor changes were made to update the Part 7 compliance questions to reflect the current provisions of Part 7 that were effective in 2010.
For example, MEWAs and ECEs must report whether they were in compliance with special enrollment provisions added by the Children’s Health Insurance Program Reauthorization Act of 2009, the Mental Health Parity and Addiction Equity Act of 2008 and the Department’s regulations issued thereunder, the Genetic Information Nondiscrimination Act of 2008 and the Department’s regulations issued thereunder, and Michelle’s Law. These revisions do not affect the hour or cost burden associated with the information collection.
