Rule 8c-1 prohibits the commingling
under the same lien of securities of customers (a) with securities
of other customers without their written consent and (b) with the
broker-dealer's proprietary securities. The rule also prohibits a
broker-dealer from hypothecating customers' securities for a sum in
excess of the customer aggregate indebtedness to the
broker-dealer.
Changes in burden are
reflective of the most recent statistics regarding number of
responses and time required for response. The number of respondents
decreased from 142 as of year-end 2006 to 111 as of year-end 2010.
The hourly burden did not change. The cost of labor was incorrectly
included in the cost burden in the prior submission, and has now
been corrected.
