The Securities and Exchange Commission
has begun the design of a new Electronic Data Collection System, a
Tips and Complaints Referral database (the Database) and invites
comment on the Database that will support information provided by
the general public that would like to file a tip or complaint with
the SEC. The database will be a web based e-filed dynamic report
based on current technology that pre-populates and establishes a
series of questions based on the data that the individual enters.
The individual will then complete specific information on the
subject(s) and nature of the suspicious activity, using the data
elements appropriate to the type of tip or complaint. The
information collection is voluntary.
The Securities and
Exchange Commission (Commission) is requesting emergency
consideration of one collection of information pursuant to 44
U.S.C. § 3507(j) as implemented by 5 CFR § 1320.13. In connection
with this request, the Commission has determined: 1. The collection
of information is needed prior to the time periods established
under the Paperwork Reduction Act of 1995, 44 U.S.C. § 3501 et seq.
(PRA) and applicable regulations, 5 CFR § 1320.1 et seq. 2. The
collection of information is essential to the mission of the
Commission. 3. The Commission cannot reasonably comply with the
normal clearance requirement of the PRA and applicable regulations
because the use of normal clearance procedures is reasonably likely
to prevent or disrupt the collection of information. 4. Pursuant to
the conversation held between the OMB desk officer and the SEC PRA
Certifying Officer, the Commission requests that OMB approve or
disapprove the collection of information by December 9, 2010. 6.
The Commission requests that OMB waive the 60 day notice
requirement set forth in 5 CFR § 1320.5(a)(1)(iv). During the OMB
emergency approval clearance timeframe, a 60 day federal register
notice will be published.
This is a new collection. The
estimated annual burden is 12,500 hours.
