Section 90.155 provides that a period
no longer than 12 months may be granted to local government
entities to place their stations in operation on a case-by-case
basis upon a showing of need. This rule provides flexibility to
state and local governments. An application for an extension of
time to commence service may be made on FCC Form 601. Extensions of
time must be filed prior to the expiration of the construction
period and will only be granted if the licensee shows that failure
to commence service is due to causes beyond its control. The FCCs
(FCC 04-166 and 06-110) which added Multilateration LMS
EA-licensees and DSRCS (Dedicated Short Range Communications
Service) to this rule section and added additional reporting
requirements for those licensees in 1995. In 2007, under DA07-479,
the FCC granted two to three additional years to meet the 5-year
construction requirement for certain multilateration LMS
EA-licenses, and extended the 10-year requirement for such licenses
two years.

OMB approval for an extension (no change in reporting
requirements). The Commission is reporting a 600 hour adjustment
decrease which is due to fewer respondents subject to the reporting
requirements in 47 CFR 90.155(b). Conversely, the Commission is
reporting a 421 adjustment increase in responses under which
certain licensees, who at the 5- and 10-year benchmarks are
required to file a map under 47 CFR 90.155(d). Therefore, the
Commission is reporting a total decrease of 179 total annual
hours.
