This collection
is approved until January 2011 under the following terms of
clearance: 1) The EEO-5 collection will not be used again after the
2010 reporting period unless it complies with OMB's 1997 standards
for data on race and ethnicity and does not conflict with the
Department of Education's (ED) collections of school staff data on
race and ethnicity. 2) During the current (2010) reporting period,
respondents claiming a reporting hardship because they collected
race and ethnicity data in accordance with ED's requirements, and
thus do not have the data in the format required by the EEO-5, will
be exempt from reporting on the EEO-5 currently in the field. To be
granted an exemption, respondents need only to inform EEOC that
they do not have the race and ethnicity information in the format
required by the EEO-5 because they collected the data in accordance
with ED's requirements. 3) Respondents granted this exemption would
need to submit an alternative report that meets the EEO-5
requirements for data regarding EEO-5 job groups and in the race
and ethnicity categories that meet ED's requirements. EEOC will
provide an alternative report format to these respondents. 4) EEOC
will provide a reasonable filing extension for respondents granted
this exemption. 5) By no later than Wednesday, November 3rd, EEOC
will announce on its website, in a prominent place, that this
exemption is available to respondents. The website announcement
will also contain clear instructions regarding who respondents can
contact about the exemption and how to get it.

EEO-5 data are used by EEOC to
investigate changes of employment discrimination against public
elementary and secondary school districts. Data are shared with the
Department of Education (Office for Civil Rights and Center for
Statistics), Department of Justice, and 23 State and 56 Local
FEPA's.
Emergency approval is
necessary to continue data collection during this reporting
period.
