On September 13, 2004, under authority
of section 112 of the Clean Air Act, EPA promulgated national
emission standards for hazardous air pollutants for new and
existing industrial/commercial/institutional boilers and process
heaters. On June 19, 2007, the United States Court of Appeals for
the District of Columbia Circuit vacated and remanded the national
emission standards for hazardous air pollutants for
industrial/commercial/institutional boilers and process heaters.
This ICR documents the recordkeeping and reporting requirements
associated with EPA's proposed rule in response to the court's
vacatur and remand.
Upon vacatur of the previous
NESHAP, the ICR was discontinued. We are now reinstating this ICR
for new proposed rulemaking.
