A. Justification.
As provided in 8 CFR 264.6, any nonimmigrant alien whose evidence of registration has been lost, mutilated or destroyed may apply immediately for its replacement. This information collection is used for such requests.
2. The data collected on this form is used by the alien temporarily residing in the United States to request a replacement of his or her arrival evidence. The information provided can be used to verify status and for determination as to the eligibility of the applicant.
3. The use of this form currently provides the most efficient means for collecting and processing the required data. In this case the U.S. Citizenship and Immigration Services (USCIS) does not employ the use of information technology in collecting and processing information. This form can be completed electronically but cannot be e-filed. However, this form has been scheduled for e-filing under the Business Transformation Project.
4. A search of USCIS’ automated forms tracking system was accomplished and revealed no duplication. There is no similar data collected.
5. This collection of information does not have an impact on small businesses or other small entities.
If this information is not collected USCIS will be unable to determine or verify an alien's claim of eligibility for nonimmigrant status and the alien would not be able to replace a lost, stolen or destroyed Form I-94 (Arrival/Departure Record), Form I-94W (Visa Waiver Arrival/Departure Record) or Form I-95 (Crewmen's Landing Permit).
7. There are no special circumstances applicable to this information collection.
8. USCIS published a 60-day notice in the Federal Register on March 23, 2010 at 75 FR 13771. USCIS published a 30-day notice in the Federal Register on June 23, 2010 at 75 FR 35823. USCIS did not receive any comments for this information collection.
USCIS does not provide payments or gifts to respondents in exchange for a benefit sought.
10. There is no assurance of confidentiality.
11. There are no questions of a sensitive nature.

Total annual reporting burden is 5,073. This number is calculated by multiplying the number of respondents 12,195 x (1) number of responses x .416 (25 minutes) per response.
13. There are no capital or start-up costs associated with this information collection. Any cost burdens to respondents as a result of this collection are identified in item 14. There is a $320 fee charge associated with the filing of this information collection.

Government Cost
The estimated cost of the program to the Government is calculated by multiplying the estimated number of respondents 12,195 x $320 suggested fee charge, (which includes the suggested average hourly rate for clerical, officer, and managerial time with benefits), plus a percent for the estimated overhead cost for printing, stocking, distributing and processing of this form.
Annual Public Cost
The estimated annual public cost is $3,953,131. This is based on the number of respondents 12,195 x (1) number of responses x .416 (25 minutes) per response x $10 (average hourly rate); plus the number of respondents 12,195 x $320 fee charge.
15. There has been no increase or decrease in the annual burden hours previously reported for this information collection.
16. USCIS does not intend to employ the use of statistics or the publication thereof for this collection of information.
