SUPPORTING STATEMENT

(Form 9452)



  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


The RUF Program was initiated in 1992. Each year approximately 72% of the taxpayers contacted through the RUF Program stop filing unnecessary returns.


Form 9452 is a tool to aid individuals in determining whether it is necessary to file a Federal tax return. Form 9452 will not be collected by the IRS; it is to be used by individuals at their discretion. Form 9452 is used by the VITA and TCE programs, by District taxpayer assistance sites, on the Internet, and in an annual mailout to taxpayers.


  1. USE OF DATA


The use of the worksheet is optional. It is provided as an aid for the taxpayer to determine whether or not they have to file a Federal tax return. The worksheet can then become part of the individual's tax file if desired.

  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


We have no plans at this time to offer electronic filing because of the low volume compared to the cost of electronic enabling.


  1. EFFORTS TO IDENTIFY DUPLICATION


We have attempted to eliminate duplication within the agency wherever possible.


  1. METHODS TO MINIMIZE BURDEN ON SMALL BUSINESSES OR OTHER SMALL ENTITIES

Periodic meetings are held between IRS personnel and representatives of various professional groups to discuss tax law and tax forms. During these meetings, there is an opportunity for those attending to make comments regarding the collection requirements under this form.


In response to the Federal Register Notice dated November 19, 2009 (74 FR 60032), we received no comments during the comment period regarding Form 9452.

Generally, tax returns and tax return information are confidential as required by 26 USC 6103.

  1. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register Notice dated November 19, 2009 (74 FR 60032), requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.

  1. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT


The primary cost to the government consists of printing and mailing the worksheet, letter and reminder notice. We estimate that the cost of printing and mailing the form is $280,000.


  1. REASONS FOR CHANGE IN BURDEN


There is no change in the paperwork burden previously approved by OMB. We are making this submission to renew the OMB approval.
