On February 17, 2009, the President signed Public Law 111-5, the American Recovery and Reinvestment Act of 2009 (the “Recovery Act”), including a number of provisions to be implemented in Federal Government contracts. This interim rule implements section 1512, which is also known as the “Jobs Accountability Act.” Paragraph (c) of section 1512 requires contractors that receive awards (or modifications to existing awards) funded in whole or in part by the Recovery Act, to report quarterly on the use of the funds.
The interim rule was published on March 31, 2009 in advance of the system being developed in order to provide contractors ample notice that a reporting requirement was required as a condition of receipt of funds. The system will not be available until October 1, 2009. The rule cannot be finalized until the system is available and its function and process are understood. This extension is required to allow the FAR Council the opportunity to evaluate the system's impact on burden and the rule.
