[The FERC-725 renewal request was originally submitted to OMB on 5/7/09 (ICR No. 200904-1902-005). The renewal noted a substantial increase to the reporting burden. To address OMB’s questions of 7/10/09 and following consultation with OMB, ICR No. 200904-1902-005 was withdrawn. However, concurrent with the withdrawal, this revised package is being submitted to clarify the burdens and costs (as described in questions 12 through 15). There is no change to either the FERC-725 regulations or information collection.] Legislation, giving FERC additional responsibilities, enhanced the Commission’s efforts to strengthen the reliability of the nation's interstate electric grid. The Electricity Modernization Act of 2005 was enacted into law (on 8/8/05) as part of the Energy Policy Act of 2005 (“EPAct 2005”). Subtitle A of the Electricity Modernization Act amended the Federal Power Act (FPA) by adding a new section 215, titled “Electric Reliability.” Section 215 of the FPA buttresses the Commission’s efforts to strengthen the reliability of the interstate grid through the grant of authority for a system of mandatory Reliability Standards developed by the Electric Reliability Organization (ERO)and reviewed and approved by FERC.

Because the program and requirements were at the preliminary stages in early 2006, an applicant had not been selected to be the Electric Reliability Organization (ERO), and Regional Entities and Regional Advisory bodies had not yet been created, it was difficult at the initial clearance to estimate burden, the no. of respondents, responses, and cost. The ERO has been selected, and the program has been established. Based on information from the ERO and FERC staff, the previous burden and cost estimates (in the initial clearance, as well as the 60-day Notice related to this clearance request) have been revised and better reflect the operations of the program.
