A. Justification


1. Form 7507, General Declaration (Outward/Inward), is the only form used by air carriers arriving in or departing from the United States, to meet the needs of the Customs and Border Protection (CBP). The form is used to document clearance by the arriving aircraft at the required inspectional facilities and inspections by appropriate regulatory agency staffs. It is also used to report illness or disease, and to report the disinfecting and sanitary treatments to prevent the introduction of harmful diseases and/or insects into the United States where they could cause devastating damage to or destruction of plant and animal life in this country. This form is used pursuant to the provisions of 18 U.S.C. 1699, 19 U.S.C. 1431, 1433, and 1644a; 39 U.S.C. 602(b): 19 CFR 122.43, 122.48, 122.54, 122.73, and 122.144.


2. CBP Form 7507 is used by the airlines as a declaration attesting to the accuracy, completeness and truthfulness of all other documents that make up the manifest. The form also allows the airlines to meet the needs of four separate Federal inspection agencies. If this information were not collected, several Federal agencies would be unable to enforce their regulatory requirements.


3. With the development and implementation of ACE, CBP is currently scheduled to automate this process in 2012


4. This information is not duplicated elsewhere.


5. This information collection does not involve small businesses.


6. If the information was collected less frequently Federal regulations would not be adhered to and penalties could be assessed against the airlines.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. Public comments were solicited through two Federal Register notices dated March 16, 2009 (Volume 74, Page 11125) and on May 21, 2009 (Volume 74, Page 23877). No comments were received.

12. Estimated Annualized Burden on The Public is 83,333 hours. This is based on an estimated 500 respondents averaging 2,000 responses each for a total of 1,000,000 responses. The estimated average time per response is 5 minutes per response for a total estimated burden of 83,333 hours.


Estimated Annualized Cost on the Public. The estimated cost to the respondents is $1,660,000. This is based on an estimated 1,000,000 responses, each requiring 5 minutes (83,000 hours) at an average cost of $20.00 per hour.


13. Estimated Record Keeping Burden on the Public. There is no record keeping burden requirement for this information collection.


Estimated Capitalization Cost Burden on the Public. There are no capitalization cost associated with this collection.


14. Estimated Annualized Cost to the Federal Government. The estimated cost to the Federal Government associated with collecting, analyzing and processing this information is $11,550,000. This is calculated by 20 minutes expended per response (1,000,000) = 330,000 hours x an estimated rate of $35.00= $11,550,000.

16. This information collection will not be published for statistical information.


17. CPB will display the expiration date for OMB approval of this information collection.


18. CBP does not request an exception to the certification of this information collection.
