SUPPORTING STATEMENT




  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


The collection of information relating to vehicle donations to charitable organizations is required by statute. See §§ 170(f)(12)(A)(1), 170(f)(12)(D) and 6720. A donee organization that received a contribution of a qualified vehicle with a claimed value of more than $500 after December 31, 2004 that provides during the calendar year a contemporaneous written acknowledgment of the donation to a donor is required to file Form 1098-C with the Service by February 28 of the next calendar year (March 31 if filing electronically). The first due date for filing the Form 1098-C is February 28, 2006. A notice needs to be published as soon as possible to tell taxpayers about the reporting requirements.

The information collected will be available to Service employees for audit purposes to verify eligibility for charitable deductions.

  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


Electronic filing is available for Form 1098-C. IRS Publications, Regulations, Notices and Letters are to be electronically enabled on an as practicable basis in accordance with the IRS Reform and Restructuring Act of 1998.

We have attempted to eliminate duplication within the agency wherever possible.

We received no comments during the comment period in response to the Federal Register notice dated March 10, 2009 (74 FR 10345).

Generally, tax returns and tax return information are confidential as required by 26 USC 6103.

  1. ESTIMATED BURDEN OF INFORMATION COLLECTION


The estimated annual reporting burden is 21,930 hours for donee organizations. The estimated annual burden per donee organization varies from 30 minutes to 16 hours, depending on individual circumstances. The estimated average annual burdens are 5 hours for donee organizations. The estimated number of donee organizations is 4,300.

  1. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register notice dated March 10, 2009, requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.



  1. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT

  1. REASONS FOR CHANGE IN BURDEN

There is a 430 hour increase in total burden due to the modifications put forth in Notice 2007-70. we are making this submission to renew the OMB approval.

Not applicable.


17. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the regulations sunset as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.


18. EXCEPTIONS TO THE CERTIFICATION STATEMENT ON MB FORM 83-1
